Can I cure default on car loan

Hi. I'm having trouble making my car payments the last few months. A while ago I got a notice that said I could 'cure' the default if a I paid the amount they said I owned. So I did. Now I'm late again and I am expecting another notice. Can I try to cure it again if I can come up with the cash?

Editor's Response

Yes.  This area of Massachusetts law is governed by MA General Law Chapter 255B, Section 20A. Paragraph (b) of that Section says: . . . "If a buyer cures a default after receiving notice and again defaults, the creditor shall give another notice before bringing an action or proceeding against the collateral with respect to the subsequent default, but no notice is required in connection with a subsequent default if, within the period commencing on the date of the consumer credit transaction subject to this section and the date of the subsequent default, the debtor has cured a default after notice three or more times."

Note the last line, however.  There is a limit to the number of times you can cure the default.  For more information or to post a question, visit our MA Consumer Law Discussion Forum.  Good luck, and please tell your friends about The Forum.
