The facts:
1. The Wooden Deck is not shown on the as built plans. A brick deck is shown on the filed plans with the deed from the developer.
2. The first buyer purchased the condo with the Wooden deck and not brick in 1983.
3. A second owner purchased the unit with the Wooden deck still attached in 1986.
4. A third owner purchased the unit again with the wooden deck in 1993.
Another owner, a neighbor in the Condominium, researched the Registry of Deeds and found this Wooden Deck not shown on the as built plans. A complaint was issued requesting the Board to have the deck removed and replaced with a birck deck as shown in the documents filed in 1983.
The question is the Wooden Deck a legal part of the Condominium or should be taken down and replaced with a brick deck.
