I've been married for 5 years but my husband has left and is living in another state. Can I file for chapter 7 bankruptcy on my own or do I have to wait till I get divorce? The debts are all in my name anyway as my husband couldn't get any credit.

Editor's Response
Yes, married couples, whether living together or not, can file a joint petition for bankruptcy or one person can file for individual bankruptcy. Usually, when both couples are jointly liable on the debts, the couple files a joint bankruptcy petition. Most Massachusetts bankruptcy attorneys offer an initial free consultation. If I were in your shoes, I would talk to an attorney, explain your situation, and get her thoughts on how to proceed. Good luck.
