Bankruptcy after foreclosure auction

We got some notice that says the bank is going to auction our house in two weeks. I'm thinking I need to file bankruptcy but if I don't get it filed till after the auction sale will that still allow us to keep the house or will it be too late for that?

You have to file bankruptcy

You have to file bankruptcy before the auction date. If you file after the sale of the house it is too late, the house is no longer yours. If I can help feel free to call. Good luck.

Editor's Response

If you wait until after the house is sold, the bankruptcy petition will have no relevance to the person who legally bought the house at auction.  He or she will be the new owner.  If you need to file bankruptcy, you should do it well before the auction to give your attorney time to complete, file and serve all required paperwork.  I'm sure attorney Kovacs would agree that time is of the essence and you should contact a Massachusetts bankruptcy lawyer TODAY.  Good luck.
