Banking records for MassHealth application.

Hello. I'm trying to get my mom signed up for MassHealth and now see I need to collect several years of banking statements and information for the application. My mom's bank says there may be a copying fee for this. Is that legal and can I somehow get the banking records for my mom without paying for them? Thanks.

MassHealth banking records

Yes.  Massachusetts General Laws Chapter 118E, Section 23A requires banks to provide the banking records without charge IF the records are requested by a representative of MassHealth.  To simplify this process the Executive Office of Health and Human Services has created a pre-signed letter that you can use.  Choose the link below that corresponds to the office where you have or will file your mother's application for MassHealth (Sprngfield, Tewksbury, Taunton, or Revere).

For Section 23A to apply, the bank, or "financial institution"  must have some connection to Massachusetts:   The Section offers the following definition: “financial institution shall mean a national bank, federal savings bank, federal savings and loan association or federal credit union, if such bank, association or credit union is authorized to transact business and has its main office or a branch office in the commonwealth; or a trust company, credit union, co-operative bank or savings bank, if such company, credit union or bank is organized and exists under the laws of the commonwealth or any other state of the United States or is otherwise authorized to do business in the commonwealth and has its main office or a branch office in the commonwealth; or a benefit association, insurance company or safe deposit company authorized to do business in the commonwealth."
