What the heck? I just got my credit card bill and there is a charge for my home security contract that I did not want to renew. I sent a letter asking them to cancel this like two months ago but now they say (I called) they did not get my letter and that I am on the hook for two more years of service. So what should I do now? Is this legal in MA? Thanks in advance.

Automatically renewing contracts
Without seeing the terms of the contract and reviewing the process you used to notify the company of your desire to cancel, I can not say if this particular 'evergreen contract" (automatically renewing) is enforceable in MA. Generally speaking, automatic renewal clauses are enforceable as long as they contain a mechanism for ending the contract. For example, the clause may say that either party can end the contract by written notice provided within 30 days of the expiration of the original term.
I do know, however, that most companies would rather let the sale go than deal with litigation or with the MA Consumer Protection Act. You should either hire a MA lawyer to write a demand letter or do it yourself. Follow this link for information about drafting a 93A demand letter. If you can show the court that the company ignored your request to cancel and then failed to respond to your demand letter, you may be entitled to triple damages and/or attorney's fees. For more information about the subject, visit our Massachusetts Consumer Protection Law Discussion Forum. Good luck.
