Attorney will not respond & Chapter 7

I need advice. In October of 2008 I filed Ch 7, making sure to keep my home & auto loans up to date & not included in the filing.

Unfortunately, my mortgage holder had an inexperienced attorney & filed a motion to reaffirm my mortgage agreement. I agreed to sign until I received the agreement & the amount to reaffirm was incorrect. I agreed to sign a corrected form.

In the meantime, the mortgage holder's attorney fees were added to my mortgage - totaling over $1500.00. We agreed they would remove the fees if I signed the reaffirmation agreement.

I received another reaffirmation agreement with the incorrect amount.

Please keep in mind that the mortgage holder is my main bank. I have my main checking & 2 savings accounts there. I have my paycheck directly deposited there weekly & the mortgage is taken out automatically each month. I have never been late & there has always been enough $ for them to remove my monthly mortgage amount.

While I was waiting for the 3rd & hopefully accurate reaffirmation agreement, my bankruptcy was officially closed. However, the mortgage company's attorney continued to add fees to my mortgage - totaling over $2,000.00.

My attorney suggested I just pay the extra fees & forget about signing anything. I just don't know what to do at this point. Any advice would be greatly appreciated. Thank you.

Sadly, my limited knowledge of bankruptcy law does not allow me to answer this question. Did you press your attorney for an explanation of why he/she thinks you should pay the fees?
