When appealing from a motion for summary judgment in MA, can a Plaintiff-Appellant argue that he failed to state a claim, or that that case was not ripe, and that the MSJ should be overturned and the case dismissed without prejudice? Or is this just ridiculous? I really don't know and have not been able to find any case law or statutes to help me. Thanks!!!
