Apartment deposit - didn't tell me the snow-covered yard was full of sharp rocks

Hi-I have a large, elderly dog who has diffuclty walking and uses a canine wheelchair. I told the broker/"landlord's representative" this up front and I talked at length to both him and the landlord about the mobility issue. The front of the house is not good for walking- it looks out on the back of an auto shop, and the neighbors would be upset by frequent urination in front of their houses, so I planned on using the back yard quite a bit. It was covered in snow and the agent did not say anything about the footing being unusual, and given the size (bigger than a patio) anyone would assume it was grass.

When I went again to sign the lease, the snow had melted and the whole yard was covered in sharp stones! Not only would this hurt a dog's feet, it would be impassable with the mobility problem. Had I known this, I would have said no thanks to the apartment immediately. I had put a money order for 1 month's rent down, which they are not giving back willingly. Am I legally entitled to this back?
