I noticed this morning that my tenant removed the air conditioner from his window without letting me know. I bought the air conditioner and installed it months before he moved in.

I plan to ask his reason for removing it but can I ask to take the air conditioner back? I'd prefer to put it in storage rather than have it lying around his apartment if he doesn't plan to use it.

Optional appliances

As you may know, if a landlord installs an optional appliance or other piece of equipment (one not required by law), he as a duty to maintain the appliance in working order and cannot remove it from the unit without the tenant's permission.  However, I don't know why the tenant would object to you storing the air conditioner during the winter months.  It would just create more room for the tenant to use for other storage.  If, for some odd reason, the tenant wants to hold on to it during the winter months, and your really want to store it yourself, I'll guess that a court would side with you, as long as the unit is returned to the tenant in the spring.  It is your air conditioner, after all, and the tenant is not using during the winter.  Frankly, if the tenant wants to hold on to it, I'd let him.  No sense creating hard feelings with a tenant.
