Adopting child who has Social security benefits

I'm the permanent guardian for my niece and she receives social security survivor benefits. My husband and I would like to adopt the child but we were wondering if that might cause her to lose her benefits. Do you know? Thank you for any help.

Depending on the type of benefits involved, it is possible that your decision to adopt the child could impact her eligibility or the amount of benefits she receives.  When you adopt her, your income may be attributed to your niece.  I know it may cost you a bit of money, but before you adopt, I would talk with a Massachusetts lawyer who deals with Social Security benefits issues and ask her to give you a more detailed response.  Based on your unique situation, the attorney will be able to give you a more definitive answer and offer her opinion regarding the question of adoption vs. guardianship.  Good luck.
