My husband & I have been separated for 4 months...... trying to work on some problems but we both decided divorce wasn't something we were willing to discuss yet. I just found out from a third party that he has gone away on vacation ( obvisously saying nothing to me) & left no emergency contact info with me incase something were to happen with our daughter (age 7) After this stunt I am ready to file for divorce just wonder if this helps me with custody.

If you follow this link, you will find a thread about the factors a court will consider in Massachusetts regarding child custody.  AS you will read, this question always boils down to what is "in the best interest of the child."  I'm not sure his going on a vacation is going to be a huge factor.  To me, the more relevant facts include his decision to leave you and to leave the child in your care, and that you are currently providing (presumably) a safe and secure home for the child.  Clearly, at this stage (where you are certain you want to move forward with the divorce), you should discuss this issue with an experience Massachusetts divorce lawyer.  Good luck.
