First question, I have been told the statue of limitation is 3 years and also 6 years. Three years will be May 31st, 2009. I have more documentation I will ever use.
Secondly, I am going Pro Se. The original Developer died, But his son, under another company took responsibility for all repairs. In other word he acted a the agent for the person (his dad) from whom built the property. All letters and discussion were with the other party (son) under a different company in regards to the repairs or lackthereof. Any opinions if you think the court will throw me out first round. What is the first round. I have a mock draft of a complaint that I am going to follow the format. BIG question: wondering if the is a seperate sub-law( that I have to refer too in complaint) for the "agent" opposed to the regular 93a statue?Anybody lives in plymouth county and can help, I am a nervous person with all this, I can pay. Also I have an expert witness on State codes paid in full to testify on my behalf-yes there were a lot of building codes violation, I am using it for back only though because I did'nt find out unitl the home warrenty expired. Many other thing discoved before the warreny expired and I paid to repair.

Under Massachusetts General Laws Chapter 260, Section 5A, most claims under MA Chapter 93A must be brought withing 4 years of the accrual of the claim. However, for this issue and for your entire claim, I would strongly urge you to contact a MA attorney (ASAP). You are probably talking about a considerable amount of money, and this type of case can become very complex. Also, in my experience, people are more likely to respond to a demand letter from an attorney than they are to respond to a letter written by a lay-person. Finally, an attorney will be able to do what I really cannot do: sort out the facts related to the agency issues and tell you who you should address the demand letter to.
