Hello! I have a tenant that started under the fixed term 1 year lease. When the lease was over, the tenant stayed and I continued to accept the rent which AFAIK established the tenancy at will. Recently the tenant commited several serious rental agreement violations, such as deliberately damaged and defaced the property, improperly disposed of trash, etc. The original 1 year lease had the provision to use a 7 day notice to terminate the tenancy in the event of breaking 1 or more of the lease conditions by the tenant. Now, as the tenant isn't under the lease anymore, can I still use a 7 day notice to quit or the 30 day notice is required ?

Use a thirty day notice to quit and do not give cause. Just terminate the lease. If you try to bring up cause, you will have to prove it.

I can prove it, I have other tenants willing to testify. Can I legally use a 7 day notice to terminate a tenancy at will? Everywhere I looked it says it's OK for the lease, but no definitive answer for the TAW.
