As you probably know, assuming the house is marital property, the issue of who gets to keep it or whether the home must be sold will be decided during the divorce process, either by agreement of the parties or by court order. Whether that process is altered by the fact that the home is a 40b property, I do not know. If you cannot afford an attorney, a good way for you to start your research on this issue might be to call the MA Office of Housing and Economic Development at 617-573-1300.
